You'd need to use an SDK for the console you're building for, and for GBA and DS, you're probably working in C. For DS, it's probably easier just to get a cheap flashcart and use that. It's perfectly possible to flash some of the reproduction/coutnerfeit cartridges out there (I've bought a few and a Game Boy Advance dumper/flasher). Those cartridges are built with read-only memory, so you can't use the original cartridges. That's a separate question from "can you get away with it?" or "do other people get away with it?"
